1. Validity of General Terms and Conditions of Sale

1 Validity of General Terms and Conditions of Sale

1.1 The General Terms and Conditions of Sale are valid between HOMEFASHION.ee e-shop clients (hereinafter Client) and HOMEFASHION.ee owner Nictara Kaubanduse Ltd. (hereinafter HOMEFASHION.ee) regarding the legal relationships created between the two when purchasing goods.

1.2 The General Terms and Conditions may not be in contravention of legal provisions valid in the Republic of Estonia and, if necessary (in the case of disputes or lack of information), are supplemented with the given provisions.

1.3 In addition to the current General Terms and Conditions, the relations between the Client and HOMEFASHION.ee are regulated by the price list and developed good practices.

1.4 HOMEFASHION.ee reserves the right to unilaterally amend these terms and conditions and the price list, for the purpose of supplementing its effectiveness, competitiveness, continued development, service and assortment of goods or reorganisation. Changes and supplements to the terms and conditions and the price list enter into force at the moment the designated information appears on the page www.homefashion.ee. If the Client communicated their order prior to the entry into effect of the changes to the terms and conditions, then the terms and conditions valid at the time the order was communicated shall apply for the Client, except if the law or these terms and conditions prescribe otherwise.

1.5 HOMEFASHION.ee and the Client wish to trade on the HOMEFASHION.ee webpage www.homefashion.ee under the terms and conditions prescribed herein. By formalising an order and executing payment in the HOMEFASHION.ee e-shop, the Client confirms that he/she has reviewed the conditions of sale and is in agreement.

2.HOMEFASHION.ee price list

2.1 The prices of products sold in the HOMEFASHION.ee e-shop are listed in EUR, exclude postage, and include 24% value added tax.

2.2 Delivery costs are fixed and can be found at checkout before completing your order.

2.3 HOMEFASHION.ee reserves the right to adjust prices. If the Client communicated their order prior to the entry into effect of price changes, then the price that was reflected on the invoice at the moment that the order was formalised shall be valid for the Client.

3. Shopping basket and formalising an order

3.1 Adding items to cart

The Client’s shopping cart is created the moment the “Add to Cart” button is clicked. After that, the Client may continue browsing or proceed to checkout at any time.

3.2 Viewing and updating cart

The contents of the shopping cart (items, quantities, and product details) can be viewed and updated at any time by opening the “Shopping Cart” page.

3.3 Placing an order

To complete the order, the Client clicks “Proceed to Checkout” and enters the required information so we can process the order, contact the Client if needed, and issue an invoice.

3.4 Delivery address changes

If the Client wishes to ship the order to a different address, the request must be sent to home@homefashio.ee
 before the order is processed.

3.5 Order accuracy

Accurate and complete information is essential for successful delivery and to avoid additional costs. The Client confirms the order by clicking “Continue” or “Proceed”.

3.6 Delivery method

The Client selects the preferred delivery method during checkout.

3.7 Order confirmation

After reviewing all details, the order is confirmed by clicking “Place Order”.

3.8 Contract formation

The sales contract is considered concluded once the payment has been received in the bank account of Nictara Kaubanduse Ltd.

4. Methods of payment

4.1 Payment methods

You can pay for your order using PayPal, credit or debit cards, or via your online bank.

Card payments (Visa, MasterCard) are processed securely. Nictara Kaubanduse Ltd. is responsible for processing personal data and forwards only the necessary payment data to the authorized payment processor Maksekeskus.

All card payments are secured using SSL encryption and 3D Secure technologies (Mastercard SecureCode and Verified by Visa), ensuring that payment information cannot be intercepted or altered by unauthorized parties.

After placing an order and selecting the Maksekeskus payment method, the Client is automatically redirected to the secure Maksekeskus payment gateway, where card details are entered.

We offer all commonly used payment methods to ensure a smooth and secure checkout experience.

4.2 Order confirmation & invoice

After the order has been placed, an order confirmation is automatically sent to the Client’s email address.

The invoice can be viewed and downloaded after order confirmation. It includes the Client’s contact details, ordered products with descriptions and prices, as well as HomeFashion legal information and bank details.

5. Delivery and transfer of products. Worldwide shipping.

5.1 Shipping partners

Once the contract has entered into force (as defined in clause 3.8) and provided clause 1.5 has been fulfilled, orders are delivered to the Client via international logistics partners, including FedEx and DPD.

5.2 Delivery options

All available delivery methods for your order and destination are shown at checkout. The selected delivery partner will deliver the parcel to the address provided by the Client at the time of ordering.

We work with trusted international shipping companies to ensure safe and reliable delivery. personal data we hold about you in the certain circumstances.

You believe that it is no longer necessary for us to hold the personal data we hold about you;
we are processing the personal data we hold about you on the basis of your consent, and you wish to withdraw your consent and there is no other ground under which we can process the personal data;

Please provide as much detail as possible on your reasons for the request to assist us in determining whether you have a valid basis for erasure. Please note, however, that we may retain the personal data if there are valid grounds under law for us to do so (e.g., for the defence of legal claims or freedom of expression) but we will let you know if that is the case.
At any time you have the right to object to our processing of data about you in order to send you promotions and special offers, including where we build profiles for such purposes and we will stop processing the data for that purpose. You can do so by changing your marketing preferences at “My Account” or by ticking “unsubscribe” at the bottom of each marketing email we send you. Please note that you will still receive emails related with the orders you make through our Website or updates to our Terms &Conditions and Privacy Policy.

6. Cancelling the order, return and exchange of the product

6.1 Order cancellation

HOMEFASHION.ee reserves the right to cancel the Client’s order if the invoice has not been paid within 24 hours.

6.2 Returns

If the goods are unsuitable or do not meet the Client’s expectations, the Client has the right to return them within 14 working days from the date of receipt.

Returned items must be unused, undamaged, with original tags attached, and in their original packaging.

Once the returned goods have been received and a return request has been submitted to home@homefashion.ee
, the refund (including original shipping costs) will be issued to the Client’s bank account no later than 14 working days after receipt of the returned goods.

Return shipping costs are covered by the seller.

7. Liability

7.1 Limitation of liability

HOMEFASHION.ee is not responsible for:

damage or deterioration of the product caused by the Client;
defects resulting from improper use or incorrect maintenance of the product;
natural wear and tear occurring through normal use of the product.

8. Liability and force majeure

8.1 Liability of HOMEFASHION.ee

HOMEFASHION.ee is liable to the Client for any damage caused by a breach of these Terms and Conditions, to the extent and in the cases provided by applicable Estonian law.

8.2 Liability of the Client

The Client is liable to HOMEFASHION.ee for any damage caused by a breach of these Terms and Conditions, to the extent and in the cases provided by applicable Estonian law.

8.3 Force majeure

Neither party shall be liable for any delay or failure to perform its obligations if such delay or failure is caused by circumstances beyond their reasonable control (force majeure).

8.4 Non-material damages

HOMEFASHION.ee shall not be liable for any non-material or indirect damages incurred by the Client, including those arising from changes in delivery times, prices, or other conditions under these Terms and Conditions.

9. Other terms and conditions

9.1 Use of personal data

HOMEFASHION.ee uses personal data solely for the purpose of fulfilling the Client’s order. All information received during order processing is treated as confidential and will not be disclosed to third parties, except where required by applicable law.

9.2 Marketing communication

HOMEFASHION.ee may occasionally send the Client information about new products, campaigns, and special offers. The Client has the right to opt out of marketing communications or request the deletion of their personal data from the HOMEFASHION.ee database at any time.

9.3 Applicable law

For matters not regulated by these Terms and Conditions, the Client and HOMEFASHION.ee shall comply with the applicable laws and regulations of the Republic of Estonia.

9.4 Dispute resolution

Any disputes arising from the performance of these Terms and Conditions shall be resolved primarily through negotiations. If an agreement cannot be reached, both the Client and HOMEFASHION.ee have the right to turn to the Consumer Protection and Technical Regulatory Authority or a competent court for protection of their rights.
